ChoralLib Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using the choral music database provided by ChoralLib (hereinafter referred to as "the Service"). Users (hereinafter referred to as "Users") agree to these Terms when using the Service.

Article 1 (Application)

  1. These Terms apply to the relationship between Users and the Service.
  2. The Service may establish additional provisions (hereinafter referred to as "Additional Provisions") as necessary. If Additional Provisions differ from these Terms, the Additional Provisions shall take precedence.

Article 2 (Service Overview)

  1. The Service is a database that collects and provides information on choral music, such as sheet music duration and required voice parts.
  2. Users can browse and add new information on the Service.
  3. The information provided on the Service only includes data that does not infringe copyright.

Article 3 (User Registration)

  1. The Service offers two types of accounts: individual Users and choral group Users.
  2. Individual Users can browse choral music, add information, and create music lists.
  3. Choral group Users have access to functions related to the registration and management of choral group information in addition to individual User functions.
  4. Registration for choral group Users is subject to verification by the Service through prescribed methods to confirm that the applicant is a legitimate representative of the group.
  5. The Service reserves the right to refuse or cancel a registration if false information is provided or if the registration is deemed inappropriate.

Article 4 (Management of Login Information)

  1. Users must manage their login credentials responsibly and must not share, transfer, or lend them to third parties.
  2. If login credentials match the registered information, the Service will assume that the User has accessed the account.
  3. The Service assumes no responsibility for damages resulting from unauthorized use of login credentials by third parties.

Article 6 (Notifications)

  1. Notifications from the Service to Users will be made through postings on the Service, email, or other methods deemed appropriate by the Service.
  2. If a notification is sent via email, it will be considered received once it is sent to the email address registered by the User.

Article 7 (Billing and Payment Methods)

  1. Payments are processed via Stripe Japan, Inc. (hereinafter referred to as "Stripe"). Users must comply with the terms and conditions of Stripe when using its payment services.
  2. Payments are non-refundable. However, in cases of Service malfunctions or other special circumstances, exceptions may be made. Users will retain access to paid membership services until the subscription period ends.

Article 8 (Prohibited Actions)

  1. Users are prohibited from engaging in the following activities when using the Service:
    • Violating laws or public order and morals
    • Engaging in criminal activities
    • Defaming, discriminating against, or damaging the reputation or credibility of others or the Service
    • Destroying or interfering with the functionality of servers or networks related to the Service
    • Using automated tools (such as spiders, bots, or scraping tools) to excessively load the Service and extract large amounts of data
    • Engaging in activities that interfere with the operation of the Service
    • Attempting or conducting unauthorized access
    • Collecting, storing, or publicly disclosing personal information of other Users
    • Causing disadvantage, damage, or discomfort to other Users or third parties
    • Impersonating other Users or the Service
    • Providing direct or indirect benefits to antisocial forces in connection with the Service
    • Any other activities deemed inappropriate by the Service

Article 9 (Service Suspension)

  1. The Service may suspend or discontinue operation without prior notice due to system maintenance or unforeseen technical issues.
  2. The Service assumes no responsibility for damages resulting from service suspension or discontinuation.

Article 10 (Voluntary Account Termination)

  1. Users may apply to terminate their accounts at any time by following the prescribed procedures.
  2. Once an account is terminated, its associated data will be deleted and may not be recoverable upon re-registration.

Article 11 (Handling of Personal Information)

  1. The Service will manage Users' personal information appropriately in accordance with the Privacy Policy.
  2. Users must comply with the Privacy Policy when using the Service.
  3. The purposes of data usage, third-party sharing, and management policies are detailed in the Privacy Policy.

Article 12 (Liability for Damages)

  1. If a User violates these Terms and causes damage to the Service or a third party, the User shall be liable for compensation.
  2. If the Service suffers damage due to a User's violation of these Terms or fraudulent actions, the Service may claim compensation from the User.

Article 13 (Disclaimer of Warranties and Limitation of Liability)

  1. The Service does not guarantee the accuracy or completeness of the information provided but strives to ensure its accuracy to the best extent possible.
  2. The Service assumes no liability for any damages resulting from the use of the Service.

Article 14 (Service Modifications)

  1. The Service may modify, suspend, or terminate its offerings without prior notice to Users.

Article 15 (Amendments to the Terms)

  1. These Terms may be modified as needed.
  2. Any modifications to the Terms will be announced on this page, and continued use of the Service will be considered acceptance of the updated Terms.

Article 16 (Dispute Resolution)

  1. If any matters are not covered in these Terms or if interpretation is unclear, Users and the Service shall resolve them through good faith discussions.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.
  2. Any disputes related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance.
